OLYMPIC WORLD LIBRARY - TERMS OF USE
These Terms of Use aim to inform you, as a user of the OWL, of the conditions under which you may use the OWL to access and view Our Content (as defined below), and reserve books and other items part of the OWL catalogue. By accessing or using the OWL , you agree to be bound by the Terms of Use described herein and by all terms, policies and guidelines incorporated by reference, including our Privacy Policy (together the “Terms”). If you do not agree to all of the Terms, please do not use the OWL .
1. What is the Olympic World Library and who are we?
The Olympic World Library is a library catalogue and portal to Olympic knowledge. It gives access to the full library collection of the Olympic Studies Centre (OSC) and allows for federated search on other publication platforms. The OWL is managed by the International Olympic Committee (the “IOC”) and by the Olympic Foundation for Culture and Heritage (the “OFCH”) which oversees the OSC. When we refer to “we”, “our” or “us”, we are referring to the OFCH and the IOC and when we refer to “you” or “your” we refer to you as a user of the OWL.
2. Contract
The Terms constitute a contract between you and us, and apply to your use of the OWL. The Terms do not alter in any way the terms and conditions of any other agreement you may have with us or our subsidiaries or affiliates.
3. Eligibility and registration process
The OWL is directed, and registration with us via the OWL is open, to persons who are 13 years old and above.
Creating a user account is not required to access the OWL. However, in order to benefit from advanced functionalities of the OWL (personalization, save favorites, etc.) and in order to reserve books or other item on the OWL catalogue, you are required to register and provide us with certain personal information. You can register by signing-up with us through the OWL. We will process any personal information provided to us for the purposes of registering on the OWL in accordance with our Privacy Policy.
The OFCH reserves the right to terminate your user account, if we believe that you do not comply with the Terms.
4. Borrowing books and other items part of the OWL catalogue
Please note that borrowing of books and other items part of the OWL catalogue is subject to the OSC Loans rules and requires a personal address in Switzerland an in-person registration at the OSC on-site. Persons who are not residents of Switzerland may borrow books and other items from the OWL catalogue only through a library from their country of domicile, by means of library-to-library loans.

5. Ownership of the OWL Website and its contents
We own all rights, including all intellectual property rights, in relation to the OWL. Unless otherwise indicated, all of the content featured or displayed on the OWL, including, but not limited to, text, graphics, data, photographic images, moving images, sound, illustrations, software, and the selection and arrangement thereof (“Our Content”) is owned by us or has been licensed to us by third party providers. All books and items available on the OWL catalogue are either our property or have been licensed to us by the respective property rights owners.
We grant you a limited, non-exclusive, revocable, non-transferable and non-sublicensable license to access and use the OWL and Our Content, for personal and non-commercial purposes only, provided that you comply with the Terms and applicable laws and in particular the following conditions:
a) You may not, under any circumstance, alter, modify or circumvent any component of the OWL, or attempt to do so, or encourage or assist any other person to do so.
b) You may not launch any automated system, including without limitation, “robots”, “spiders”, or “offline readers”, “virus”, “worms”, “Trojan horse”, having the purpose or effect to detrimentally affect the OWL.
c) You may not copy or imbed Our Content.
d) You may not use the OWL and/or Our Content for commercial or advertising purposes, or in any manner implying an association between a third party, or a third party’s product and services, and us, without our prior written consent.
e) Except as provided under paragraph f) below, you may not re-distribute, for free or in return for payment, Our Content, to any third parties without our prior written authorization.
f) You are authorized to share Our Content for personal and non-commercial purposes only and in a manner otherwise consistent with the Terms.
g) Except as expressly provided in the Terms, you may not copy, archive, reproduce, modify, broadcast, communicate to the public and/or make available Our Content, without our prior written authorization.
h) You may not transfer, assign or sublicense any rights and licenses granted to you under the Terms, but our rights and obligations may be assigned by us without restriction.
i) You may not facilitate or encourage any violation of the Terms by third parties.
All rights not expressly granted to you under the Terms remain reserved by us.
6. Trademarks
The Olympic symbol and other Olympic properties are trademarks registered in the name of the IOC, and may not be copied, imitated or used, in whole or in part, without the prior written permission of the IOC.
7. Disclaimer
You agree to the following:
a) Your use of the OWL shall be at your sole risk, and you are responsible to ensure that it is compliant with applicable laws. You are not allowed to use the OWL if such use contravenes with any law or regulation of your country of residence or of use.
b) We disclaim all liability for losses and/or damages caused by any unauthorized use of your user account and it is your responsibility to immediately notify us of any breach of security or unauthorized use of your user account;
c) Despite our efforts to provide accurate information and to prevent disruption caused by technical problems, the OWL and/or Our Content may contain technical mistakes, inaccuracies or typographical errors or be temporarily unavailable to you and we cannot be held liable for such occurrences;
d) Your use of the OWL requires one or more compatible devises, internet access and certain hardware and software and may require obtaining updates or upgrades from time to time. You agree that your ability to use the OWL may be affected by the performance of such materials and that such system requirements are under your responsibility as well as all costs incurred by their use including your internet or data service providers charges;
e) The OWL, including Our Content and the OSC catalogue are provided to you “as is” and, to the fullest extent permitted by applicable law, we (including our officers, directors, employees, agents affiliates and subcontractors) disclaim all express or implied warranties in connection with the OWL, Our Content (including any link to any third party websites, and any offer of service or product made by third parties) and the OSC catalogue and your use thereof, such as but not limited to warranties of availability, fitness for a particular purpose, and non-infringement of any applicable laws or regulations.
f) We reserve the right to modify, improve, update, suspend or terminate any functionality, or any of Our Content, at our discretion and without notice;
g) Except where expressly mentioned otherwise, links provided on the OWL to any third party websites or platforms, shall not be interpreted as a recommendation or endorsement by us;
h) Although we make our best efforts to reply to any questions asked or requests made to us through the OWL in a timely manner, we do not guarantee any specific turnaround time, reserve the right to refrain from answering any communication which does not comply with the Terms.
8. Limitation of liability
To the fullest extent admissible under law, we (including our officers, directors, employees, agents, affiliates and subcontractors) shall not be liable to you or third parties for damages of any kind arising in connection with:
a) Your access to or use of the OWL and any of Our Content, or of the websites linked to the OWL;
b) Any unauthorized access or use of our servers and/or any personal information or other information stored therein;
c) Any errors or inaccuracies in Our Content
d) Any delays, interruptions, failure, poor quality or limitations of any kind in transmissions from the OWL or in the delivery or in the performance of the services offered via the OWL; and
e) Any damages caused by or resulting from bugs or viruses.
9. Indemnification
You agree to defend, indemnify and hold us harmless (including our respective officers, directors, employees, agents, affiliates and subcontractors), against any claims or damages (including legal fees) arising in connection with your violation of the Terms. This defense and indemnification will survive the Terms and your use of the OWL.
10. Miscellaneous provisions
Any waiver of any provision of the Terms will be effective only if in writing and signed by the OFCH or the IOC. If any clause in the Terms is found to be unenforceable, to the fullest possible extent under applicable law, this will not affect any other clause and each will remain in full force and effect. Any rights not expressly granted herein are reserved.
We reserve the right to modify these Terms of Use, at any time. When we make changes, we will revise the "last updated" date at the bottom of the Terms of Use and any change will be effective immediately upon posting. We will use reasonable efforts to inform you about any material changes made to the Terms by posting a notice on the OWL. However, your continued use of the OWL following the posting of changes will constitute your acceptance of such changes. We encourage you to review our Terms whenever you use the OWL.

11. Applicable Law and Arbitration
This Agreement shall be governed by and interpreted in accordance with the laws of Switzerland.
Any dispute arising from or in connection with your use of the OWL or Our Content which cannot be settled amicably, shall be submitted to the exclusive jurisdiction of the courts of Lausanne, Switzerland.
